Karen Hornberger intentionally misrepresented a Privacy issue to polish a Record and Claim Plausible Deniability
NSHA Privacy was engaged to investigate a very serious set of Privacy Violations. But also very serious Human Rights violations which were directly tied to the accuracy of her investigation. Karen Hornberger knew by calling me a liar and misrepresenting me, it would be used to invalidate and discredit my claims about other serious abuse which included a man standing over me and touching my stomach. She knew how serious it was to dismiss this so negligently. She knew she was victimizing me. Below, we’ll go through her reply from May 25th 2023 and show she was absolutely wrong, and absolutely reasonably knew she was wrong and was doing something really bad. I will present compelling evidence my Book Bag -> Wallet -> Health Card (PHI – Privacy Breach), ID’s and Financial Information. PAGE 73 was directly involved in Privacy Breach that should have been reported by QE2 and Mount Hope. And Karen Hornberger absolutely knew it, and proactively tries to polish the record as to intentionally bias anyone reading:
Karen Hornberger (May 25th 2023) - “The first is regarding your book bag being searched by the Halifax Regional Police (HRP) on August 2nd and 3rd, 2022 at the QEII Emergency Room and then being transferred to Mount Hope where it was accessed by another patient.”

January 15th 2024 - "There is no evidence to suggest Dr. Murphy had anything to do with the transportation of your belongings to Mount Hope, or that this was done prior to you being transferred there."

August 3rd 2022 - “the clients belongings including wallet was brought to the unit with the previous client mistakenly. Scotts brown leather wallet and contents as per valuables disclaimer are in the locked cabinet”-

While, on a separate page they listed the contents of my wallet. Further confirming exactly what I’ve I was saying all along, it states “Brown Leather Wallet Contents -> health card ending in XXX, -> Drivers License -> +$40.00 CASH -> Scotiabank". Providing SIGNIFICANT support for what I'm saying and have been saying. It shows my health card was in there, and as the Health Card is PHI parties absolutely had to report the Privacy Breach. Along with Financial and Identity Privacy Breaches.

Book Bag -> Wallet -> Health Card (PHI – Privacy Breach), ID’s and Financial Information. PAGE 73. Showing there was absolutely a Privacy Breach regarding my PHI (Health Card) but also other financial and identify information. Which absolutely should have ben reported as a Privacy Breach. While my statements on the series of events have been consistently meaning it is absolutely reasonable to assert that the reason Karen Hornberger misrepresented the issue and then phrased it how she did was because Karen Hornberger knew how bad this looked on record and wanted to take proactive steps to try to justify it. Karen Hornberger knew the Police would claim they were allowed to search it at QEII, and then NSHA and Mount Hope would claim another patient got it sometime at Mount Hope. She knew this didn’t match what was being reported but knew she could lie to anyone reading her report, so they wouldn’t have reasonable questions. In short, Karen Hornberger needed to polish the face of the record so anyone looking it wouldn’t have questions. This was done intentionally and so with Malice. That’s why Karen Hornberger didn’t copy and paste what I said occurred, and why Karen Hornberger didn’t contact me to clarify. Not one single phone call. Karen Hornberger then closed the case full well knowing it would take over a year to get any type of answer while she knew it would require a lawyer just to have basic questions answered. Which is a massive level of compelled association just to have basic questions answered. Its Social Economic retaliation. And all of this directly indicates an incredible level of Negligence.
This was absolutely done with Malice. And when you see the next section, and how she basically states I deserved it, it will provide significant evidence of why she thought she could get away with it. And provide significant evidence of her pattern of victimization.
Karen Hornberger falsely claiming Clinicians can refuse to be recorded. Privacy law and 184 In the Criminal Code ensure this right. She also justifies being recorded by 2 cameras for almost 24 Hours, and basically claims Sign Language is not communication.
Now secondly. This is regarding March 13th 2023.
Karen Hornberger (May 25th 2023) - “The refusal by staff to allow or not allow you to record your session is not strictly a Privacy related matter. If you were recorded by staff without a reason or notice it would be a Privacy issue. Recording of patients in certain areas of the Emergency department is only done to ensure the safety of patients and no audio is captured.”
A note on physician use of smartphone recordings
Although patients can record their clinical encounters without a physician’s consent, the same does not hold true for physicians. Clinicians who wish to record a clinical encounter should first obtain informed consent from the patient, and that consent discussion should be noted in the medical record. Some Colleges may require the use of a separate consent form for this purpose.

•€€€€€€€€€Karen Hornberger knew Staff stated not allowing me to record was for THEIR PRIVACY and nothing to do with a “therapeutic session” which is absolutely fraud.
o Karen Hornberger knew I was told that if I didn’t talk about it I would just be admitted and was told if I insisted on recording I would just be admitted.
o Karen Hornberger knew I stated I was falsely arrested again and compelled as a witness against myself by NSHA staff. While NSHA staff were judge, jury and executioner where them and directors who ordered the hit piece had everything to loose by me being innocent. Knowing there was absolutely no sense of impartiality from NSHA.
o Karen Hornberger knew this wasn’t a “therapeutic” session. Karen Hornberger was advised a NSHA Director had me arrested and take from my Car just after filing complaint at Halifax Regional Police, while they knew I was submitting complaints against NSHA.
▪⬝⬝NSHA Staff told me if I didn’t speak about the core issue, I would just be admitted and if I didn’t cooperative I would just be admitted. And when I asked to record for fairness I was told no. I even explained 184 in the Criminal Code, and explained what is sometimes called the 1 part consent law. NSHA Staff then told me I was making it all up and when asked which part they said “I don’t know”.... as NSHA staff recorded their subjective and so intentionally fraudulent record... They were judge, jury and executioner who had everything to gain by me being guilty. If not they would have to complain against the director and police.
•€€€€€€€€€Karen Hornberger knew that in both occasions August 2022 and March 2023 I was directly and repeatedly claiming I was being denied a lawyer.
•€€€€€€€€€Karen Hornberger knew I advised staff on 184 in the Criminal Code. Even advised I can’t record in common areas but in one on one we can. I asked for their privacy policy, the refused to provide one stating this was for THEIR Privacy.

Karen Hornberger was told, that March 13th – 14th 2023 I was then forced to stay in a Room (Open access to AYONE in emergency) for almost 24 Hours with 2 Cameras recording me. With absolutely no privacy. The doors were unlocked and so any person could walk in while I’m sleeping... What about my Safety? Karen Hornberger knows both this fraudulent record and videos can all be subpoenaed by my abusers. Karen Hornberger knows no person would EVER agree to that and Karen Hornberger knows the excessive manner it was conducted is a MASSIVE privacy violation. For instance, without me saying anything the first thing my Family said was OMG THEY ARE RECORDING YOU and wouldn’t close the door....As any rational or decent person would be shocked. Please really stop and think about what Karen Hornberger is saying. Actions are not language? So if you are Deaf, sign language is not communication? All my phone calls were recorded. Different instances of my communications, such as my phone would have been recorded. My Family were recorded. This was 24 Hours while I was being held against my will and being denied a lawyer. While NSHA wouldn’t provide a reason or privacy policy.

Recommendation and Request to NSHA, College and RCMP – Karen Hornberger, Karen Oldfield, and Nicole Boutilier will be terminated with Cause on their HR Files. Any and all severances will be donated to Charity

They provided me with a list of names, but it doesn't seem to match the name of the person I was assigned too.
- I would like to clarify the names.

OIPC Backlog Information:
I also want to pass along our most recent 2023-2024 Annual Report, which provides more detail and information about the backlog at the OIPC. There is information about our backlog throughout the report, but specifically, see the Commissioner’s Message on page 6, and the Annual Backlog Update on page 14.
How to request your file to be expedited:
In rare instances, the Office of the Information and Privacy Commissioner (OIPC) may expedite a file. To be fair to all applicants, the OIPC assigns files in chronological order. We have three existing exceptions to chronological assignment: time extension requests, deemed refusals and some privacy breach investigations. In the case of time extensions and deemed refusals these files are dealt with immediately because if we failed to do so the remedy sought would be moot. In the case of some privacy breach investigations, we deal with these matters immediately because the harm may be ongoing and notification of affected individuals may be essential to preventing further harm.
In any other circumstance, the OIPC will only expedite an applicant’s request and give it priority over other applications in exceptional circumstances. The burden is on the applicant to satisfy the OIPC that the circumstances are exceptional. To qualify as an exceptional circumstance the applicant must show:
- The matter is urgent and specific;
- The privacy breach is not yet contained;
- The privacy breach is systemic;
- The privacy breach is an ongoing privacy breach or very likely to happen again;
- Health and safety concern; and
- Overwhelming public interest.
In considering a request to expedite we will take into account such factors as:
- Any delay on the part of the applicant in making his or her original complaint or in filing the request for review;
- The applicant’s ability to effect change with the information;
- The existence of other administrative processes;
- The merit of any public interest argument; and
- The likelihood of success – is the case law clear regarding the privacy complaint at issue?
If a request to expedite is approved, it may be approved on an issue-limited basis to address only the urgent portion of the request.
If you want to request that the OIPC expedite this file, please send your request in writing on or before July 25, 2024 including any applicable exceptional circumstance(s) and any relevant factor(s) listed above to oipcns@novascotia.ca. Once a request to expedite and the necessary information is received, management with the OIPC will contact you to issue a decision on whether the file will be expedited in due course.

I've attached the form. But I would like to state that currently I'm quite poor, my mother recently passed away and I'm left with all the bills and only a single pay cheque to pay for it all.

Ohhh NSHA.....
Even RCMP was refusing to arrest me... Because NSHA choice was never based on evidence, dignity or due process...it was Phishing Campaign and it’s pretty clear NSHA did it in retaliation for the signs I carried around the morning of March 13th 2023... “JDIRrving, Postmedia, HRP – Framed and Tortured Me”. - https://tinyurl.com/msrrf9u4 .
NSHA knew their failures would now reflect on these other “right kinds of white”, such as JDIrving, Postmedia and HRP and NSHA got desperate. And then stripped my rights.
While I was calm, cool and collected the entire time.

Oh and AUgust 2nd - 3rd It was during the transfer from QEII emergency, to Mount Hope. My bookbag was alreadyt waiting. The next day, the homeless guy came up to me saying DUDE YOU CANT TALK AROUND POLICE...I woke up fucked up and hugging your bookbag and we went through all of it" and then asked to Rock Paper scissors for one of the 20's.

August 2nd and 3rd 2022 was at QEII Emergency, this is where my bookbag was given to these officers.
And it wasn't just an employee, it was also the Psychologist and the Doctor. All levels were denied.
And yes, that i was kept in the room for 24 Hours, and being recorded. And wondering what my reasonable expectation of Privacy would be. Especially considering NSHA claim, that taking my rights of recording, was to protect their Privacy... this doesn't make any sense whatsoever.
Your summary, altho worded differently than what I would have chosen, captures the essence, yes.

You are reporting this as a Privacy concern. Can you verify which facility or facilities this occurred at?
Your other concern is that while you were at NSH you were denied the opportunity to record a discussion between you and an NSH employee and were told this was due to Privacy concerns. Because of this you feel that your rights have been violated.
You are also concerned about being recorded while in a room at NSH.

August 2nd and 3rd 2022 - NSHA has been asked to explain on the events of With a primary focus on what happened with my Bookbag, and how it ended up with two non-related HRP Officers and A Homeless person who rummaged through it. NSHA has been requested to report he breach to the Privacy Commissioner, especially as the reason I was arrested was because I simply wanted to file a complaint against and open a case with HRP... So... You can see why it’s so concerning two non-affiliated HRP Officers got my book bag... It was reported, to the Main Thread the Morning of August 3rd 2022. But also that NSHA and HRP refused to let me talk to a lawyer as I sat in handcuffs for over 10 hours... But I digress on that Humiliation...
March 13th 2023 - Now more troubling... NSHA knew of multiple serious complaints against them and Police. But NSHA had me falsely arrested on under IPTA. RCMP refused the arrest and pushed back but NSHA made them. Neither RCMP, HRP nor CSIS are refuting my evidence. None of them had a problem. But NSHA picks me up and completely disregards IPTA protocol. Then, when told the entire story and then that I had recorded them all... NSHA knew I 100% caught them. They leave the room. And come back with someone else, these two people Tell me I am not allowed to record our 1 on 1’s... I advised this is false, there are issues recording in common areas but I have the right to record. And that this is covered under the One Part consent law... They then took me into a room, with 2 CAMERAS RECORDING and they said this as not and THRETAED severe violence if I did not give up my phone. NSHA then made a false record of what I was saying... full well knowing they wouldn’t let me record it... The Officers seen the evidence before hand and were shocked... But then think about this... they are pretending to be Victims, and it’s about “their Privacy”... as I’m being humiliated and demeaned... But to show how bad this really was.... NSHA then made me stay in that room, with those Cameras for 24 Hours... I slept there, farted there, got boners there... everything recorded. Even discussions with my family... A much more detailed security review will be submitted. It’s absolutely appalling. NSHA pretended they were the victims.... it's horrific. Consider, if they thought someone had a mental illness or a “Vulnerable” person. Look what they did to frame and hurt a vulnerable person... Basically they thought they could get away with it, because I’m just some “retard”... It’s Horrific. Oh and to be clear, they gave my phone back AFTER they falsified the record... it was all so they could intentionally lie, cheat, steal and cover it up. While inside this room, I was given maybe enough food to feed a small child. They then lied to all my support, isolated me and shipped me off to Yarmouth.... a 12 Round trip for any of my family...

This was intentional. And I am requesting NSHA and RCMP investigate this as a Hate Crime towards me and my family. This was absolutely Criminal Assault Criminal Negligence, A massive a Breach of Trust, Unlawful confinement and absolutely Coercive Torture.
I would suggest NSHA get this right because the evidence I have against NSHA and Doctor Holms is amazing... The Public is going to be shocked... they are going to see you Monsters for what you really are... And I will absolutely be seeking and pursuing serious criminal charges against NSHA and its employees. Regardless, NSHA has to carify the privacy issues...
Now NSHA... can you advise on the statements made regarding recording, making me sleep in a room with Cameras and my Book Bag? I expect these breaches to be reported to the Privacy Commissioner of Nova Scotia.
